Title Lien Statements
UCC Filings
Liens on Boats
The
perfection and discharge of a security interest in any property which has been
issued a Kentucky certificate of title shall be by notation on the certificate
of title (KRS 186A.190).
Property
required to be titled:
Vehicle (KRS 186.010(8)(a))
Manufactured (or mobile) home or trailer. (KRS 186A.070)
Motorboats (KRS 186A.015, KRS235.055)

record a lien on a vehicle, mobile home, trailer or motorboat a title lien

The
following information & documents are required:

Name(s) of the debtor and their
address
¨
Name of secured party (the person
or Bank lending money) & their mailing address
¨
Description of collateral (year,
make, vehicle identification number)
¨
Title or goldenrod copy of
registration if a pending lien has been filed
Place
of filing:
Generally,
a title lien filing should be made in the county of the debtor’s residence if
an individual, and in the county of principal headquarters of a resident
business or in the county of principal use of the titled property, if the
business or individual is a nonresident.
Duration of filing:
Effective July 1, 2001, Title Lien Statements will have
a statute of limitations of 7 years for vehicles and 30 years for mobile homes.
Any Title Lien Statement on record prior to July 1, 2001 that would expire due
to the statute of limitations may be continued during a six month transition
period ending December 31, 2001. There is no filing fee for a continuation
statement. Title Lien Statements recorded after July 1, 2001 will need to have a
continuation statement filed (if necessary) within the six month period prior to
expiration.
Liens
on Boats
Liens on boats are
filed in the same manner as vehicles. If
the boat has a full inboard motor, the title lien statement is filed on the boat
and a separate one for the trailer.
Titles for the boat & trailer are required to record. The filing fee
is paid for each title lien statement filed.
If the boat is
inboard/outboard or has a full outboard motor, a title lien statement is filed
on the boat & a separate one for the trailer.

Transfer
of Ownership:
Ownership transfer is prohibited until any and all existing lien
notations are terminated in writing by the secured party of record.
This termination must be filed in the county where the lien was filed.
Only the county where the lien is filed may cancel the lien in AVIS.
Repossessions-KRS
186.045(4)
Any repossession transaction processed by a secured party must be
processed in the county where the lien was filed.

Termination Statement:
The secured party is
required to file a termination statement within ten days after the loan is paid
in full (KRS 186.045(2)). This
termination statement must be filed in the county where the lien was originally
filed. The clerk shall within five
days note the termination in his records and enter it in the statewide vehicle
registration system.

Effective July 1, 2001, all new UCC filings will be filed with the Kentucky Secretary of State's Office, with the exception of the following:
Title Liens
Fixture Filings
Timber (to be cut)
Minerals to be extracted

Any fixture filing, or filing on timber to be cut, or minerals to be extracted would be designated to be filed in the real property records and must contain a reasonable description of the real estate.
New legislation eliminates the requirement for signatures of either the debtor(s) or secured party(s) on any UCC document or Title Lien Statement filed.
A UCC filing must have the name and address of the debtor and must identify the debtor as an individual or organization. A UCC filing must also have the name and address of the Secured Party (Lender).
